Please read these Terms & Conditions carefully before submitting an application. By submitting an application for the 5 Sponsored Website Builds campaign, you confirm that you have read, understood, and agreed to be bound by the terms outlined below.

1. Eligibility & Verification

• Location: Participation is open exclusively to legally operating, locally based businesses in the Tri-Cities, Washington area (Kennewick, Pasco, Richland, and immediately adjacent communities).

• Authorized Representation: The applicant must be at least 18 years of age and possess the legal authority to enter into agreements on behalf of the named business.

• Operational Requirement: The business must provide an active service, trade, or product. Speculative, non-operating entities or inactive concepts are not eligible.

2. Scope of the Sponsored Offer

• Included Services: The sponsorship covers custom website design, structured mobile optimization, core on-page conversion layout, and basic contact/lead capture setup.

• Waived Labor: Verge Marketing Solutions will waive 100% of standard upfront design and development labor fees for the five (5) selected recipients.

• Excluded Third-Party Costs: The sponsorship covers professional creative and development labor only. Ongoing third-party operational costs—including, but not limited to, custom domain registration, ongoing web hosting, third-party plugin/software licenses, or payment processing transaction fees—remain the sole financial responsibility of the client.

3. Application & Selection Process

• Submitting an application does not guarantee selection, service delivery, or contract award.

• Exactly five (5) businesses will be selected at the sole discretion of Verge Marketing Solutions based on business readiness, quality of existing assets, and suitability for the agency’s launch portfolio.

• Selected businesses will be contacted directly via the phone number or email address provided on the application.

4. Client Responsibilities & Turnaround Timelines

• Asset Submission: Selected recipients agree to provide all required core business information, logos, high-resolution imagery, and service descriptions within fourteen (14) calendar days of notification.

• Communication & Reviews: Selected businesses agree to provide prompt feedback on design drafts within five (5) business days of submission.

• Forfeiture: Failure to submit required assets or maintain active communication may result in immediate forfeiture of the sponsorship, after which an alternate applicant may be selected.

5. Promotional Rights, Case Studies & Reviews

• Portfolio Usage: By participating, selected businesses grant Verge Marketing Solutions a non-exclusive, perpetual license to display the completed website, design mockups, brand assets, and general performance data (such as page speed benchmarks and traffic metrics) across agency marketing channels, including social media, portfolios, and case studies.

• Feedback & Testimonials: Selected businesses agree to provide honest feedback and a brief testimonial/review upon successful site completion and handover.

6. Ownership & Intellectual Property

• Upon project completion and final launch, the client retains full ownership of their custom text, proprietary branding, and media assets.

• Verge Marketing Solutions retains ownership of proprietary design frameworks, reusable code libraries, and agency staging templates until full handover is finalized.

7. Warranties & Limitation of Liability

• “As-Is” Delivery: Website services are provided on an “as-is” and “as-available” basis upon client sign-off.

• No Revenue Guarantees: While websites are built using industry-standard conversion and performance practices, Verge Marketing Solutions makes no express or implied warranties regarding specific search engine rankings, sales volumes, lead generation numbers, or revenue increases.

• Campaign Modification: Verge Marketing Solutions reserves the right to modify, pause, or terminate this promotional campaign at any time without prior notice if required by operational constraints.
